Man sues Chania Girls School for forcefully vaccinating his daughter without his permission

THIKA, KENYA – A Kenyan man -who has never vaccinated his daughter- is taking Chania Girls High School to court for forcefully and unconstitutionally vaccinating her without his consent.

According to the letter dated 16th February 2022, Mathew Ochieng’s daughter was vaccinated on 14th February 2022 in the afternoon and a confirmation message sent to him.

“I received a message from MOH-CHANJO On 14th February 2022 at 14.53 and it reads, “Congratulations… on receiving your 1st dose of Pfizer vaccine batch no. FG3532. Next dose is on Mon 14/03/2022 MOH””, Said Ochieng’s attorney, Kennedy Ochieng’.

Ochieng’ says despite having been in the school earlier in the morning, the administration neither informed him of vaccination plans nor sought his consent.  He was surprised to learn in the afternoon that his daughter had been forcefully vaccinated.

In the letter, addressed to the School’s principal Mrs. Mary Muthoni Mwangi, the attorney has penned four questions seeking clarification or else she face legal action for the damages caused.

The questions read;

“1. Who in Chania Girls High School precincts authorized injection of my daughter with experimental drugs without my consent?”

“2. Why was my daughter, under duress, coarsed and forcefully injected against even the Gillick Competency Test?”

“3. Why did you not seek parental consent despite the father having been in school in the morning of the 14th February 2022?”

“4. Is there a Ministry of Education circular that authorized the forceful vaccination of my daughter signed by the Cabinet Secretary? Kindly attach a copy herein for my reference.”

Muthoni has been given 24 hours to respond or else face legal action without any further reference to her.

“I give you personally, your Deputy Principal, Mrs. Maina in your individual capacity, Chania Girls High School 24 hours to respond failure, or not, which I reserve the right to legal action for damages without any further reference to your further demand.”

The parent has also stopped the school from administering any other injection to his daughter without first seeking his consent in writing.

“No further Covid-19 related injection or dose be administered on my daughter while in the Chania Girls High School precinets without my express consent in writing.”
